Established by Law 13,932/19, the FGTS Anniversary Withdrawal allows workers to withdraw part of the balance in their FGTS account annually, in the month of their birthday.
Signing up for the Anniversary Withdrawal is optional; those who do not opt in will remain in the standard system, which is the Termination Withdrawal.
CAIXA warns that it is important to know the characteristics of each method when opting for the Anniversary Withdrawal:
- Withdrawal-Termination: system in which the worker, when dismissed without just cause, has the right to withdraw the entire amount from the FGTS account, including the termination fine, when due. This is the standard method in which the worker joins the FGTS.
- Anniversary Withdrawal: optional system in which annually, in the month of his/her birthday, the worker can withdraw part of his/her FGTS balance. If the worker is dismissed, he/she may only withdraw the amount corresponding to the termination fine and may not withdraw the full amount from the account.
Anniversary Withdrawal Modality
The annual withdrawal amount in this modality is determined by applying a rate, which varies from 5% to 50% on the sum of all balances in the worker’s FGTS accounts, plus an additional portion, as per the appendix to Law 8,036/90, as per the table below:

About the advance withdrawal of the FGTS Anniversary Withdrawal
Established by Resolution 958 of April 24, 2020, it regulates the alienation or fiduciary assignment of the right to the anniversary withdrawal of the FGTS linked account, as referred to in § 3 of art. 20-D of Law No. 8,036, of May 11, 1990.
Workers who opt for the FGTS Anniversary Withdrawal can take out a loan with authorized financial institutions, using the amount to which they are entitled annually as collateral. CAIXA clarifies that, to carry out a loan simulation, the worker does NOT need to previously opt for the FGTS Anniversary Withdrawal.
When a worker takes out a loan with an authorized financial institution and uses the Anniversary Withdrawal as collateral, the legislation determines that the balance of the worker’s FGTS account be blocked in an amount sufficient so that, when the rate (from 5% to 50%) is applied to the sum of all FGTS account balances, plus the additional installment, the amount equivalent to the advance payment made is available.
In other words and in a simpler way: what is blocked in the worker’s FGTS balance for other transactions is not the amount he borrowed, but rather the amount that represents the calculation basis to arrive at the amount actually borrowed.

- Through the FGTS application, you must opt for the FGTS anniversary withdrawal option;
